DECLINING REAPPOINTMENT
Article XXIV of our contract gives the university administration “management rights.” This includes, but is not limited to, the right to determine or modify the number, qualifications, scheduling, responsibilities and assignment of adjunct and part-time faculty” Additionally, Section B of the article states that “decisions regarding who is taught, what is taught, how it is taught and who does the teaching involve academic judgment and shall be made at the sole discretion of the University.”
That said, adjunct faculty have the right to decline assignments that are impossible to meet due to scheduling or other conflicts. Adjunct faculty with reappointment rights can, if eligible, exercise their rights under Article X, Section C of the collective bargaining agreement and take unpaid leave while still maintaining reappointment rights.
Some things to be mindful of if you plan on declining your reappointment under Article X, Section C:
You MUST state in your letter to your department that you are exercising your right under Article X, Section C to decline reappointment to (X class(es)) and preserve your reappointment rights.
We strongly recommend that you contact a union rep at nyu@actuaw.org to confirm that you have reappointment rights to the class and help you with language for your letter informing the department of the declination
You can decline reappointment for one academic year:
If you have had appointments for two semesters in each of the previous 4 academic years
If you have had appointments for eight semesters in each of the previous 4 academic years
You can decline reappointment for one semester if you have had appointments for one semester in each of the six previous academic years
Declining reappointment only preserves your reappointment rights and continues to maintain your existing service eligibility for the Annuity Plan. It does not preserve your eligibility for health insurance, which is based on a one-year look back.
REAPPOINTMENT letter checklist
Reappointment letters for academic year 2026 - 2027 (Fall, Winter, and Spring semesters) were due on May 21.
If you have reappointment rights, you should have received your letter by this date. If you did not, please notify us immediately at nyu@actuaw.org so we can work with you to investigate the issue and file a grievance if necessary. The last day to file grievances related to issues with your May 21 reappointment letters is June 12. If you did receive your reappointment letter, be sure to review it to make sure that it includes all of the required information.
ELECTION COMMITTEE WANTS YOU!
The Election Committee oversees and conducts all the Local’s union elections. It’s a big responsibility: we have thousands of members across our units who are eligible to run and vote in our elections. Democracy is the lifeblood of a member-driven union, and we need a fully staffed election committee to make democracy happen!
We will be having elections for our Standing Election Committee during the JC Meeting on June 26th at 2pm. Members of the Election Committee serve a three year term.If you are a member in good standing of Local 7902, and you do not plan to run for a local-wide elected position, you should nominate yourself to join the election committee. No prior experience volunteering with the union necessary!
Process to Self-Nominate and Run:
Attend our JC meeting on Friday, June 26th at 2PM where we will be taking nominations from the floor, then take a vote for each candidate. If you are not a JC member, you can write in the Q&A that you want to self nominate and we will move you to the panelist side to state your intent to run. Please be prepared with a short candidate statement of why you are running.
OR
You can fill out this self nomination form and the recording secretary, or a unit JC representative, will bring your nomination to the floor on your behalf, and each such nomination will be voted on. Please complete this form by noon June 25th.
